Below you will find our General Terms and Conditions (GTCs)

1. Scope

1.1 The following General Terms and Conditions in the version valid at the time of booking the event (hereinafter referred to as "GTC") apply exclusively to the business relationship between BWE-Service GmbH, registered in the commercial register of the Charlottenburg District Court (Berlin) under HRB 185909 B, EUREF-Campus 16, 10829 Berlin (hereinafter referred to as "BWE-SERVICE") and the participant. BWE-SERVICE does not recognize any deviating conditions of the participant unless BWE-SERVICE has expressly agreed to their validity in writing.

1.2 The participant is a consumer if the purpose of participating in the respective event cannot be attributed predominantly to his/her commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity or authority who, when booking the event, is acting in the exercise of his/her commercial or independent professional or public-law activity.

1.3 BWE-SERVICE offers, in particular but not exclusively, the following types of events: face-to-face events such as seminars, industry days and conferences, as well as web formats such as web (seminars) and web events such as career fairs.

2. Registration/conclusion of contract

2.1 Registration for the events is only possible online via https://www.ee-hub.de or https://kee.ee-hub.de/ using the registration forms prepared for you. Our seminar offers based on these terms and conditions are non-binding and subject to change. However, your registration is to be viewed as a binding contract offer and will be processed by us in the order in which it is received. Before submitting the registration, the participant can change and view the data at any time. However, the application can only be submitted and transmitted if the participant has actively agreed to the inclusion of these terms and conditions by ticking a box and has thereby included them in their application. Unless otherwise stated in the registration, BWE-SERVICE is entitled to accept the contract offer from BWE-SERVICE within one week of its receipt at the latest (hereinafter "acceptance period"). BWE-SERVICE is entitled to reject the participant's application at any time without stating reasons. In this case, registration will not take place. Registration will also not take place if BWE-SERVICE has not confirmed the registration within the acceptance period. If the event is already fully booked, we will contact you immediately, otherwise we will send you your registration confirmation.

2.2 After submitting the registration on the website, BWE-SERVICE will send the participant an automatic confirmation of receipt by email, in which the registration will be listed again. The automatic confirmation of receipt merely documents that the participant's registration has been received by BWE-SERVICE and does not constitute acceptance of the participant's application. The contract is only concluded when BWE-SERVICE submits the declaration of acceptance, which is sent with a separate email (registration confirmation). In this email or in a separate email, the contract text (consisting of registration, general terms and conditions and registration confirmation) is sent to the participant by us on a permanent data medium (email or paper printout) (contract confirmation). The contract text is stored in compliance with data protection regulations.

2.3 The contract is concluded in German.

3. Participation fees

3.1 The participation fees shown on the respective event page on the booking date apply. The prices stated (including cancellation fees) are net prices in EUR. In addition to the net price, statutory VAT is charged. The participation fee is due for payment when the participant receives the invoice. Payments are to be made without deduction to one of the accounts stated on the invoice.

3.2 Members of the German Wind Energy Association receive special conditions for booking events. These are shown on the respective event page. In addition, we offer employees of authorities and students special conditions, which are communicated on request and depend on the respective event format. In order to use the conditions, proof from us, e.g. a current certificate of enrollment, can be requested. On request, companies can be made a separate offer if they need more training.

3.3 The various discount options we offer cannot be combined. This also applies to total prices that have already been discounted. If you subsequentlyIf I partially cancel, the above-mentioned discount will be withdrawn or charged retrospectively.

3.4 The invoice will be sent to the participant as an electronic invoice by email in PDF format, unless the participant requests that the invoice be sent in writing by post. The participant must ensure that internal processing notes, payment codes and invoice incoming email addresses are already transmitted in full during the booking process. The participant is also responsible for correctly specifying the company name as the basis for invoicing. We reserve the right to charge a processing fee for invoice corrections due to inaccurate or incorrect information.

4. Implementation of the events

4.1 BWE-SERVICE conducts the events both in person and in the form of online events. The type and location of the event can be found on the respective event page at https://www.ee-hub.de or https://kee.ee-hub.de/. The participation fee for face-to-face events includes admission, event materials, refreshments during breaks and lunch as per the respective event page. If they are part of the program as per the respective event page, excursions and evening events are also included. Hotel accommodation and travel costs are not included in the participation fee.

4.2 For online events, only participation in the respective event and, if applicable, the provision of the event materials in digital form are included. These are made available to the participant before or after the online event via the participant's user account on https://www.ee-hub.de.

4.3 The presentations at our events are subject to copyright. Accordingly, the use of the materials is reserved exclusively for the participant personally. The documents may not be passed on to other people in digital or printed form or reproduced in any other way. BWE-SERVICE assumes no liability or guarantee for the timeliness, completeness and accuracy of all documents provided as part of the event.

5. Changes and cancellations of events | Cancellation of a booking

5.1 BWE-SERVICE is entitled to make content and organizational adjustments (e.g. time frame, breaks, etc.) in the event program before or during the event, provided that this does not significantly affect the participant of the event. For important reasons (e.g. illness) or for organizational reasons, BWE-SERVICE can use a different speaker on the event date, deviating from the event program. As a result of the change of speaker, the participant does not have the right to withdraw or to reduce the participation fee.

5.2 BWE-SERVICE can change an in-person event to an online event. The participant will be informed of this within a reasonable period of time before the event in question takes place. If the participation fee for the online event is cheaper than the participation fee for the face-to-face event, the participant will receive a refund of the difference. In this case, the scope of services of an online event applies.

5.3 We reserve the right to cancel the event up to 14 calendar days before the start of the event for organizational reasons (e.g. due to insufficient number of participants). If possible, we offer a free rebooking to an alternative date. If participation on the alternative date is not possible or the event is not rescheduled, any participation fees already paid will be refunded in full.

5.4 Any further liability and compensation claims that do not concern injury to life, body or health are excluded unless there is intent or gross negligence on our part. This also applies to wasted expenses (e.g. hotel rooms booked by you and flight or train tickets). Otherwise, the provisions of the "Liability" section in accordance with Section 6 of these General Terms and Conditions apply.

5.5 BWE-SERVICE reserves the right to determine appropriate measures and suitable hygiene concepts in advance of the individual events, in particular due to third parties (e.g. conference hotels and conference organizers) or official requirements. In addition, individual events are held under the legal access rules applicable in the individual federal states on the date of the event. We will inform all participants in good time before the start of the event (by email) if and which regulations apply at the time of the event.

5.6 BWE-SERVICE also reserves the right to exclude participants for reasons offrom the event without good reason. An important reason exists in particular, but not exclusively, if the respective participant has given the impression through previous behavior that either their participation in the seminar cannot ensure the smooth running of the seminar and/or the participant has acted or is acting against the interests of BWE-SERVICE. The discretion to assess this situation rests solely with BWE-SERVICE. Participation fees already paid will be refunded. There are no further claims against BWE-SERVICE.

6. Liability

6.1 Claims by the participant for damages are excluded. Excluded from this are claims for damages by the participant resulting from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by BWE-SERVICE, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

6.2 In the event of a breach of essential contractual obligations, BWE-SERVICE is only liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the participant has claims for damages resulting from injury to life, body or health.

6.3 The restrictions in sections 6.1 and 6.2 also apply to the benefit of BWE-SERVICE's legal representatives and vicarious agents if claims are asserted directly against them.

6.4 The liability limitations resulting from sections 6.1 and 6.2 do not apply if BWE-SERVICE has fraudulently concealed the defect or has provided a guarantee for the quality of the item. The same applies if BWE-SERVICE and the participant have reached an agreement on the quality of the item. The provisions of the Product Liability Act remain unaffected.

7. Cancellation policy

7.1 Consumers have a statutory right of cancellation when concluding a distance selling contract, about which BWE-SERVICE informs them below in accordance with the statutory model. The exceptions to the right of cancellation are regulated in paragraph (2). Paragraph (3) contains a sample cancellation form.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier takes possession of the goods.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of cancellation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the inexpensive standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier. You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to a handling that is not necessary to check the quality, properties and functioning of the goods.ang with them.

7.2 The right of withdrawal does not apply to contracts for participation in BWE-SERVICE events in accordance with Section 312g Paragraph 2 No. 9 of the German Civil Code.

8. Cancellation a booking by participants

8.1 Subject to the following regulations, you can withdraw your registration at any time without giving reasons. Cancellations must be sent by email to the following email address: seminare@wind-energie.de.

8.2 Cancellations from face-to-face events that are received by us later than 10 calendar days before the event and if the participant does not attend or cancels the event will be charged the full participation fee.

8.3 For online events, participation can be canceled free of charge up to the day before the event; after that, the full participation fee will be charged.

8.4 A participant can be represented by another person from the same company and must be notified to BWE-SERVICE immediately by email at seminare@wind-energie.de.

9. Out-of-court dispute resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved. BWE-SERVICE is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Final provisions

10.1 Contracts between BWE-SERVICE and the participant are subject to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the state in which the participant as a consumer has his/her habitual residence, remain unaffected.

10.2 If the participant is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the participant and BWE-SERVICE is the registered office of BWE-SERVICE.

10.3 Should any provision of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the relevant statutory provision. The same shall apply in the event of a regulatory gap.
