4. Data collection on our website

Cookies

Leaving comments on this website

If you use the comment function on this site, the time at which you created the comment and your email address will be stored along with your comment, as well as your username.

How long comments are stored

The comments and the associated data (e.g. IP address) are stored and remain on our website until the content commented upon has been completely deleted or the comments are required to be removed for legal reasons (slander, etc.).

Processing of data (customer and contract data)

We collect, process, and use personal data only insofar as it is necessary to establish, or modify legal relationships with us (master data). We collect, process and use your personal data when accessing our website (usage data) only to the extent required to enable you to access our service or to bill you for the same. Data transmitted when entering into a contract with online shops, retailers, and mail order

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract, for example, to companies entrusted to deliver goods to your location or banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent. Data transferred when signing up for services and digital content

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract with us, for example, to banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent. The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.

CDN (Content Delivery Network)

We use a CDN to store content in different locations on different servers and thus make it quickly and smoothly accessible to our website visitors. This service is provided to us by DigitalOcean LLC, 101 Avenue of the Americas, New York, NY 10013.
The following data may be collected:

5. Analytics and advertising

Google Analytics

This website uses Google Analytics, a web analytics service. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. Google Analytics cookies are stored based on Art. 6 (1) (f) DSGVO. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising. IP anonymization

We have activated the IP anonymization feature on this website. Your IP address will be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of the website, to compile reports on website activity, and to provide other services regarding website activity and Internet usage for the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with any other data held by Google.

Outsourced data processing

We have entered into an agreement with Google for the outsourcing of our data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic data collection by Google Analytics

This website uses Google Analytics' demographic features. This allows reports to be generated containing statements about the age, gender, and interests of site visitors. This data comes from interest-based advertising from Google and third-party visitor data. This collected data cannot be attributed to any specific individual person. You can disable this feature at any time by adjusting the ads settings in your Google account or you can forbid the collection of your data by Google Analytics as described in the section "Refusal of data collection".

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising programme of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google").
Within the framework of Google AdWords, we use so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that the internet browser stores on the user's computer. These cookies lose their validity after 30 days and are not used to personally identify the user. If the user visits certain pages of this website and the cookie has not yet expired, Google and we will be able to recognise that the user clicked on the ad and was redirected to this page.
Each Google AdWords customer receives a different cookie. The cookies cannot be tracked across AdWords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. The customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. 6. Newsletter

If you would like to receive the BWE Event-Newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data for sending the requested information and do not pass it on to third parties.
The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.
The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after you unsubscribe from the newsletter. Data stored by us for other purposes (e.g. e-mail addresses for the member area) remain unaffected by this.
Due to our legitimate interest regarding efficient advertising according to Art. 6 para. 1 lit. f DSGVO, we analyze our newsletter campaigns by conducting statistical surveys that provide us with information, for example, about how many recipients opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed, among other things, whether a predefined action (e.g. booking an event) has taken place after clicking on the link in the newsletter. You can only escape these analyses by unsubscribing from our newsletter.
The dispatch of our newsletter and its statistical analysis is carried out by a so-called order processor, which was carefully selected by us under data protection and security aspects and contractually obligated to data protection in accordance with Art. 28 DSGVO.
The data provided by the participant of BWE-Events is available to BWE-Service GmbH. BWE-Service GmbH treats the data confidentially and uses it to inform you about current innovations and further offers of BWE. If you do not wish to receive information and offers in the future, you can object to the use of your data by us for advertising purposes at any time. Purposes of data processing of your personal data

Organization of online meetings, online information events and press conferences, video conferences, training courses and/or webinars (hereinafter: "online events").
The data provided by the participant when booking an event is available to BWE-Service GmbH. BWE-Service GmbH treats the data confidentially and uses it to provide information about current innovations and other offers from BWE. If you no longer wish to receive information and offers in future, you can object to the use of your data by us for advertising purposes at any time. To do so, use the e-mail address seminare@wind-energie.de or the unsubscribe function in every newsletter.

What personal data is collected?

IP address: In order to carry out the online event, the IP address used by your end device must be processed.
The following personal data is processed:

- User details: First name, last name, e-mail address, company (optional), position (optional), title (optional)
- Meeting metadata: Topic, description (optional), participant IP addresses, device/hardware information
- For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of the online meeting chat.
- When dialing in by phone: information on the incoming and outgoing phone number, country name, start and end time. If necessary, further connection data such as the IP address of the device can be saved.
- Text, audio and video data: You may have the opportunity to use the chat, question or survey functions in an "online event". In this respect, the text entries you make are processed in order to display them in "online events" and, if necessary, to log them.
- In order to enable the display of video and the playback of audio, the data from the microphone of your end device and from any video camera of the end device will be processed accordingly for the duration of the event. You can switch off or mute the camera or microphone yourself at any time via the "Zoom" applications.
- The questions asked by participants can be processed for the purposes of recording and following up online events.
- In order to participate in an "online event" or enter the "meeting room", you must at least provide your name and e-mail address. 
- The possibility of software-based attention monitoring ("attention tracking") in online meeting tools such as Zoom is deactivated.
- If you are registered with Zoom as a user on your own responsibility, reports on online events (meeting metadata, telephone dial-in data, questions and answers in online events, survey function in online events) can be stored on Zoom for up to one month.

Legal basis for the processing of your data

Art. 6 para. 1 lit. b) GDPR, insofar as the meetings are held within the framework of contractual relationships or contract initiation. If there is no contractual relationship, the legal basis is Art. 6 para. 1 lit. f) GDPR, which corresponds to our interest in the effective implementation of "online events" as well as cost and time savings for all participants. If we want to record "online events", we will ask you for permission to do so (Art. 6 (1) a GDPR) and make the recording recognizable.

Duration of data storage

After the purpose has ceased to apply, i.e. usually after the end of the "online event" or after the recording purpose has ceased to apply.

Recipients of your personal data

Personal data that is processed in connection with participation in "online events" is not passed on to third parties unless it is intended to be passed on. Please note that content from online events and face-to-face meetings is often used to communicate information with customers, interested parties or third parties and is therefore intended to be passed on.

Purposes of data processing:

Photo and video recordings for documentation and for publication on our web presences including Linkedin, Instagram, X, Youtube as well as in our newsletters and print publications for PR purposes (coverage of current and past events) and for advertising future events. 

Legal basis:

Art. 6 (1) a) Your consent for photographs of individuals
Art. 6 (1) f) for group photos, in the context of our legitimate interests, which are not overridden by your interests, fundamental rights or fundamental freedoms. 
We have weighed our interests - in addition to the exceptional circumstances of Section 23 KUG (Art Copyright Act) - as follows:

  • We only collect image and sound recordings with correspondingly transparent information to the persons depicted:

    • We regularly provide information about image and sound recordings when advertising an event and/or during the registration process for the event.

    • Personal notification is always provided by the organizer on site. 

    • Participants who do not wish to be recorded will be asked on site to contact the photographer/videographer directly so that their request can be taken into account.

    • We only use recordings in accordance with the reasonable expectations of those depicted. As a matter of principle, we do not produce unfavorable or compromising images.

    • Individual persons are always only part of an overall picture and will not be used by us as the main photo subject without verifiable consent.

Duration of data storage:

General: After the purpose of the data processing no longer applies or with your objection after a renewed weighing of interests or the revocation of your consent, the recordings will be deleted.
Photos not used after the event will be stored for a period of three years and then destroyed.

If you object to the publication of image and sound material by us, we will take this objection into account in future publications. We can only remove material already published on our websites with your help if you inform us of your motives and the specific recording in accordance with Art. 21 GDPR and we come to the conclusion that your interests outweigh ours as part of a new balancing of interests.
If the storage is based on your consent (recordings of individuals), we will delete the recordings of you if you withdraw your consent.

Recipients of personal data: 

As part of our press work, we send photos to the local press and use them for the above-mentioned social media channels.

9. Plugins and tools

YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here the YouTube server is informed about which of our pages you have visited. If you're logged in to your YouTube account, YouTube allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account. YouTube is used to help make our website appealing. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO. Vimeo

Our website uses features provided by the Vimeo video portal. This service is provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. If you visit one of our pages featuring a Vimeo plugin, a connection to the Vimeo servers is established. Here the Vimeo server is informed about which of our pages you have visited. In addition, Vimeo will receive your IP address. This also applies if you are not logged in to Vimeo when you visit our website or do not have a Vimeo account. The information is transmitted to a Vimeo server in the US, where it is stored.
